Please read these Terms of Service carefully before using Still Here. By creating an account or using the app you agree to be bound by these terms. If you do not agree to these terms please do not use Still Here.

1. What Still Here Is

Still Here is a daily wellness check-in app designed to help elderly parents and their adult family members stay connected. The app allows a parent to tap a button each morning to let their family know they are okay, and allows family members to receive notifications and send personalized morning messages.

Still Here is a communication and connection tool. It is not a medical device, emergency response system, or substitute for professional care. If you or someone you know is experiencing a medical emergency please call 911 or your local emergency services immediately.

2. Accounts and Eligibility

• You must be at least 13 years old to create an account
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate information when creating your account
• One person may create accounts for both a family member and a parent profile

4. Acceptable Use

You agree to use Still Here only for its intended purpose of family wellness connection. You agree not to:

• Use Still Here for any illegal purpose
• Attempt to gain unauthorized access to any part of the app or its infrastructure
• Upload content that is harmful, offensive, or violates the rights of others
• Use the app to harass, monitor, or harm another person without their consent
• Attempt to reverse engineer or copy any part of the app
• Create accounts for people without their knowledge or consent

5. Content You Share

You retain ownership of all photos, voice messages, and text you upload to Still Here. By uploading content you grant Still Here a limited license to store and deliver that content to the family members you have chosen to share it with.

We do not use your personal content for any purpose other than delivering it within your family circle. We do not sell, share, or use your content for advertising.

6. Privacy

Your use of Still Here is also governed by our Privacy Policy available at hellostillhere.com/privacy. By using Still Here you agree to the collection and use of information as described in our Privacy Policy.

7. Disclaimers

Still Here is provided as is without warranties of any kind. We do not guarantee that the app will be available at all times or that notifications will be delivered without delay. Push notification delivery depends on your device settings, internet connection, and your mobile operating system.

Still Here is not a safety monitoring service or emergency alert system. Do not rely on Still Here as the sole means of monitoring the wellbeing of a vulnerable person. Always have additional safety measures in place.

8. Limitation of Liability

To the fullest extent permitted by law, Still Here and its creators shall not be liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability to you shall not exceed the amount you paid for Still Here in the 12 months preceding any claim.

9. Changes to These Terms

We may update these terms from time to time. We will notify you of significant changes through the app. Continued use of Still Here after changes constitutes acceptance of the updated terms.

10. Governing Law

These terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

11. Termination

We reserve the right to suspend or terminate accounts that violate these terms. You may delete your account at any time from within the app or by contacting us directly.
